Nature of Business and Products Sold
Carplaylux is a pure-play online retailer. We do not operate any physical retail premises. All transactions are completed exclusively through our Shopify-powered storefront at carplaylux.com. Our catalogue currently contains over 600 vehicle-specific products, with prices ranging from approximately €150 to €4,859. All prices displayed on the storefront are inclusive of applicable VAT.
We specialise in the following eight product categories. Each product listed on our store is confirmed for compatibility with specific vehicle makes, models, chassis codes, and production years before any order is dispatched:
Wireless Apple CarPlay Systems
Retrofit wireless CarPlay multimedia head units matched to factory dashboards, wiring harnesses, and screen dimensions of specific vehicle platforms including BMW, Audi, Mercedes-Benz, Porsche, Jaguar, Bentley, and Aston Martin.
Android Auto Multimedia Units
Android-based infotainment systems, digital cluster upgrades, and dual-screen configurations for select BMW, Audi, Mercedes-Benz, Kia, Honda, and other platforms. Android versions 12–14 depending on the product.
OEM & OEM-Style Headlights
Genuine used OEM headlight assemblies and factory-specification replacements, including RGB and app-controlled DRL variants. Genuine used parts are sold as used, inspected before listing.

Every order placed through carplaylux.com is subject to a vehicle compatibility verification step. Our team confirms your VIN, make, model, and year before releasing the order for fulfilment. If a compatibility issue is identified, we notify you before shipping — never after — and offer a suitable alternative or a full refund.
Governing Law and Jurisdiction
Applicable Law. These terms, and any dispute or claim arising from or in connection with your purchase from Carplaylux, are governed by and construed in accordance with the laws of the Netherlands, specifically including the Dutch Civil Code (Burgerlijk Wetboek, BW), the Dutch Electronic Commerce Act (Wet op het electronisch bestellen), and the relevant EU regulations applicable to the Netherlands as a member state.
Courts of Jurisdiction. Any dispute that cannot be resolved through our customer service process (see Section 12 for our dispute resolution procedure) will be subject to the exclusive jurisdiction of the competent courts in Dordrecht or Rotterdam, Netherlands, unless mandatory consumer protection laws in your country of residence require otherwise.
Consumer Rights Preserved. Nothing in this choice-of-law clause deprives any consumer of the protection provided by mandatory provisions of the law of their habitual residence under EU Regulation 593/2008 (Rome I) and EU Regulation 1215/2012 (Brussels Ia). Consumers in Belgium, the Czech Republic, France, Germany, Hungary, Italy, Croatia, Austria, Portugal, Slovakia, Slovenia, and Spain retain all rights under the mandatory consumer protection laws of their own country in full.

EU Consumer Rights Framework
As a Netherlands-based online retailer selling to consumers across the European Union, Carplaylux is subject to the full body of EU consumer protection legislation. The following provisions apply as a minimum baseline to all orders, regardless of which of our thirteen served countries you reside in. Country-specific variations and extensions are detailed in Section 5.
Consumer Rights Directive — 14-Day Right of Withdrawal
You have the right to withdraw from your contract with us within 14 calendar days of the day you receive your goods — without giving any reason. To exercise this right, contact us at info@carplaylux.com before the deadline expires. Exceptions apply to goods that are made to your specification or clearly personalised. Our full return process is set out in our Return & Refund Policy.
Sale of Goods — Legal Conformity Guarantee
New goods must conform to the contract at the time of delivery. The statutory conformity guarantee for new goods runs for a minimum of two years from the date of delivery. For used (pre-owned OEM) goods, the guarantee period may be reduced to a minimum of one year where the customer has been expressly informed of this reduction, which we disclose on each used product listing. Portugal and Spain have extended their national guarantee to three years for new goods — see Section 5.
Digital Content and Services
Where a product we sell incorporates or is bundled with software (such as the Android operating system pre-installed on infotainment units), the relevant provisions of the Digital Content and Digital Services Directive apply in addition to the goods conformity rules. Software conformity obligations extend for the period during which the software is reasonably expected to be supplied with updates necessary to maintain conformity.
Product Liability
The EU Product Liability Directive 2024/2853/EU (which modernises and replaces Council Directive 85/374/EEC) establishes liability for damage caused by defective products. As a distributor of goods to EU consumers, Batterijen.net operates within this framework. See Section 10 for the full product liability disclosure.
Digital Services Act
Carplaylux operates a standard online retail storefront and is classified as an online platform under the DSA. We are a small-to-medium enterprise under DSA definitions. GDPR — Data Protection
Personal data collected and processed in connection with orders placed through carplaylux.com is handled in accordance with the General Data Protection Regulation (GDPR). Batterijen.net is the data controller. Full details of how we collect, use, store, and protect your personal data are set out in our Privacy Policy. See also Section 13 of this Legal Notice.

As an EU-based online retailer, Carplaylux operates under a shared baseline of EU consumer law, which each country below enforces through its own competent authority and national legislation. The disclosures below are provided to ensure full transparency for consumers in each market we serve. Expand the relevant country to read the applicable rules and national authority contact details.
Belgium — FOD Economie / SPF ÉconomieNational Regulatory Authority: Federal Public Service Economy (FOD Economie / SPF Économie), Control and Mediation Division. Website: economie.fgov.be.
Governing National Law: Belgian Code of Economic Law (Wetboek van economisch recht / Code de droit économique), Books VI and XIV, implementing EU consumer directives including the 14-day right of withdrawal and the two-year legal conformity guarantee.
Key National Requirements: Belgian law requires clear pre-contractual disclosure of total price (inclusive of all taxes and fees), the seller's full identity, delivery conditions, and the right of withdrawal before a contract is concluded. Misleading "before/after" price comparisons are prohibited under Belgian CEL Book VI. Where goods are offered in both Dutch and French, consumer communications must be available in the language of the consumer's region.
Withdrawal Period: 14 calendar days from the day of delivery, consistent with Directive 2011/83/EU as implemented in Belgium.

Governing National Law: Czech Civil Code (zákon č. 89/2012 Sb., Občanský zákoník), specifically §§1810–1867 governing consumer contracts and distance selling; the Consumer Protection Act (zákon č. 634/1992 Sb.); and Government Regulation No. 363/2013 Sb. on model withdrawal forms.
Key National Requirements: The seller must provide clear pre-contractual information in a comprehensible manner. The consumer is entitled to a model withdrawal form and full written confirmation of the contract including the right of withdrawal instruction.
Withdrawal Period: 14 calendar days from the day of delivery.

Alternative Dispute Resolution: The ČOI operates an ADR scheme for consumers resident in the Czech Republic. Complaints can be submitted via the ČOI website. Cross-border complaints can also be referred to the European Consumer Centres Network (see Section 12).
National Regulatory Authority: Direction Générale de la Concurrence, de la Consommation et de la Répression des Fraudes (DGCCRF). Website: economie.gouv.fr/dgccrf.
Governing National Law: French Consumer Code (Code de la consommation), Articles L221-1 to L242-1 (distance contracts and right of withdrawal); the French Loi pour la confiance dans l'économie numérique (LCEN, Loi 2004-575 du 21 juin 2004) which requires full disclosure of the seller's identity, registered address, VAT number, and representative on any commercial website accessible from France.
Key National Requirements: The French Consumer Code requires explicit confirmation of the right of withdrawal, a model withdrawal form, and clear total-price disclosure before order confirmation. Under Article L111-1, the seller must disclose the essential characteristics of the goods. The garantie légale de conformité (legal conformity guarantee) and garantie des vices cachés (hidden defect guarantee) both apply. Under French law, the return shipping costs in case of withdrawal are borne by the seller if the goods cannot be returned by normal postal means due to their nature. For products in our catalogue that can be returned by standard parcel, return shipping costs are the consumer's responsibility unless we state otherwise in individual offers.
Withdrawal Period: 14 calendar days from the day of delivery (délai de rétractation).
Conformity Guarantee: 2 years for new goods; minimum 1 year for used (pre-owned OEM) goods where disclosed at point of sale. Under French law, the consumer may assert conformity claims for 2 years from delivery without needing to prove the defect existed at the time of delivery (during the first 12 months, proof is presumed).
Alternative Dispute Resolution: In accordance with Article L612-1 of the French Consumer Code, we participate in an ADR scheme. French consumers may contact a certified mediator, or the European Consumer Centre France (see Section 12).
National Regulatory Authority: Consumer protection in Germany is enforced regionally through the Verbraucherzentralen (consumer advice centres) and civil courts. Federal oversight is provided by the Federal Office of Justice and the Bundesnetzagentur for specific regulated products. Complaints can be directed to the relevant regional Verbraucherzentrale. Governing National Law: German Civil Code (Bürgerliches Gesetzbuch, BGB), §§312 ff. governing distance contracts, §§437–442 governing seller's liability for defects (Sachmängelhaftung), and §§474–479 governing consumer goods sales. The Preisangabenverordnung (PAngV) requires all prices to be displayed as total prices inclusive of tax. The Telemediengesetz (TMG), §5 requires a full Impressum including the registered business name, address, VAT number, and a contact means that allows rapid direct communication.
Impressum / German Mandatory Identification: The statutory Impressum for Carplaylux / Batterijen.net is provided in full in Section 1.0 of this document. The absence of a compliant Impressum constitutes an infringement under §5 TMG (Abmahnung risk). This Legal Notice constitutes our Impressum.
Key National Requirements: A model withdrawal form in German must be available to consumers. German consumers are entitled to receive the withdrawal instruction and the model form at point of order. Under BGB §355, the right of withdrawal must be communicated clearly before the contract is concluded. The Widerrufsbelehrung (withdrawal instruction) and Muster-Widerrufsformular (model withdrawal form) required under the German implementation of Directive 2011/83/EU are available upon request by email to info@carplaylux.com.
Electronics and WEEE: Electronic products sold into Germany that fall within the scope of the Elektro- und Elektronikgerätegesetz (ElektroG) implementing the WEEE Directive (2012/19/EU) are registered and comply with applicable take-back requirements. Customers who wish to return electronic waste at end-of-life may contact us at info@carplaylux.com for instructions.
Withdrawal Period: 14 calendar days from the day of delivery (Widerrufsrecht).
Conformity Guarantee: 2 years for new goods; minimum 1 year for used (pre-owned OEM) goods where disclosed. Under BGB §477, a burden-of-proof reversal applies: for one year after delivery, it is presumed that any defect existed at the time of delivery.
ADR Statement (§36 VSBG): Pursuant to §36 of the German Consumer Dispute Resolution Act (Verbraucherstreitbeilegungsgesetz, VSBG), we inform you that Batterijen.net / Carplaylux is neither obligated nor willing to participate in a consumer dispute resolution procedure before a consumer arbitration board (Verbraucherschlichtungsstelle). Notwithstanding the foregoing, we encourage consumers to contact us directly at info@carplaylux.com to resolve disputes amicably (see Section 12 for further alternative dispute resolution options).
National Regulatory Authority: Consumer protection matters in Hungary are administered by regional government offices (Kormányhivatal) under the supervisory framework of the Ministry of National Economy. The National Consumer Protection Authority coordinates at national level. Website: fogyasztovedelem.kormany.hu.
Governing National Law: Hungarian Civil Code (Polgári Törvénykönyv, Act V of 2013); Government Decree No. 45/2014 (II.26.) on the detailed rules of contracts between consumers and businesses (a fogyasztó és a vállalkozás közötti szerződések részletes szabályairól), implementing Directive 2011/83/EU; and the Consumer Protection Act (Act CLV of 1997).
Key National Requirements: The seller must provide pre-contractual information in a clear, comprehensible manner. The consumer must receive explicit confirmation that by clicking the order button, they are entering into a payment obligation (fizetési kötelezettség). Government Decree 45/2014 also requires a model withdrawal form to be provided.
Withdrawal Period: 14 calendar days from the day of delivery.
Conformity Guarantee: 2 years for new goods; minimum 1 year for used (pre-owned OEM) goods where disclosed at point of sale.
Alternative Dispute Resolution: Hungarian consumers may submit complaints to the relevant regional Békéltető Testület (Conciliation Body). Contact details for all regional bodies are available from the Hungarian National Consumer Protection Authority (see also Section 12).
National Regulatory Authority: Italian Competition Authority (Autorità Garante della Concorrenza e del Mercato, AGCM). Website: agcm.it. The Unione Nazionale Consumatori and other recognised consumer associations also provide consumer support.
Governing National Law: Italian Consumer Code (Codice del Consumo, D.Lgs. 206/2005, as amended by D.Lgs. 21/2014 and D.Lgs. 170/2021); D.Lgs. 70/2003 implementing the e-Commerce Directive — Article 7 requires the mandatory identity disclosures (see Section 1.0); Italian Civil Code (Codice civile) Articles 1490–1497 on product defects (vizi della cosa venduta).
Key National Requirements: Under the Italian Consumer Code, the seller must disclose whether return shipping costs in the event of withdrawal are borne by the consumer. Where return shipping is at the consumer's cost, this must be stated clearly and the estimated cost indicated where possible. For standard returns within policy, we do not charge the consumer return shipping costs. Withdrawal Period: 14 calendar days from the day of delivery (diritto di recesso). If withdrawal is not properly communicated, the period extends to 12 months under Italian law.
Conformity Guarantee: 2 years for new goods; minimum 1 year for used (pre-owned OEM) goods where disclosed. Under Italian law, the consumer must notify the seller of a defect within 2 months of discovery.
Alternative Dispute Resolution: Italian consumers may use the Arbitro Bancario Finanziario for financial disputes, or contact the European Consumer Centre Italy for cross-border disputes (see Section 12). Consumer associations such as Altroconsumo also provide mediation support.
National Regulatory Authority: State Inspectorate (Državni inspektorat), consumer protection division. Website: direktno.hr.
Governing National Law: Croatian Consumer Protection Act (Zakon o zaštiti potrošača, ZZP, Official Gazette 41/2014 and subsequent amendments); Croatian Act on Electronic Commerce (Zakon o elektroničkoj trgovini, ZET) implementing the e-Commerce Directive; Croatian Civil Obligations Act (Zakon o obveznim odnosima).
Key National Requirements: The seller must provide the mandatory pre-contractual information under the ZZP, including full seller identity, total price, delivery conditions, and withdrawal rights. All mandatory information must be clear and legible. The consumer must acknowledge that the order creates a payment obligation.

Alternative Dispute Resolution: Croatian consumers may submit complaints to the State Inspectorate. Mediation services are available through the Centar za mirenje pri HGK (Croatian Chamber of Commerce Mediation Centre) (see also Section 12).
National Regulatory Authority: Netherlands Authority for Consumers and Markets (Autoriteit Consument & Markt, ACM). Website: acm.nl. The ACM is the primary consumer protection supervisory authority and the lead authority over Carplaylux / Batterijen.net as a Netherlands-registered business.
Governing National Law: Dutch Civil Code (Burgerlijk Wetboek, BW), Book 7, Title 1 (sale of goods) and Book 6, Section 5.2B (distance contracts); Wet handhaving consumentenbescherming (Whc, Consumer Protection Enforcement Act); Handelsregisterwet (Dutch Commercial Register Act) requiring KVK registration (Batterijen.net KVK 82259844).
KVK Registration Requirement: The Dutch Handelsregisterwet requires every commercial enterprise to be registered with the Netherlands Chamber of Commerce (Kamer van Koophandel, KVK) and to disclose its registration number on its website and commercial correspondence. Batterijen.net is registered under KVK number 82259844. This disclosure satisfies the statutory obligation.
BTW (VAT) Disclosure: As a Netherlands-registered business, Batterijen.net is VAT-registered under number NL003661115B65. All prices on the storefront are displayed inclusive of applicable Dutch VAT where applicable.
Withdrawal Period: 14 calendar days from the day of delivery (herroepingsrecht).
Conformity Guarantee: 2 years for new goods; minimum 1 year for used (pre-owned OEM) goods where disclosed.

National Regulatory Authority: Austrian consumer protection is primarily administered by the Federal Ministry of Social Affairs (Bundesministerium für Soziales) and enforced by the Consumer Information Association (Verein für Konsumenteninformation, VKI). Website: vki.at. The Internet Ombudsman (Internet Ombudsmann) at ombudsmann.at also handles e-commerce disputes.
Governing National Law: Austrian E-Commerce Act (E-Commerce-Gesetz, ECG, BGBl. I Nr. 152/2001), §5 requiring mandatory identity disclosure for commercial websites; Austrian Distance and Foreign Transactions Act (Fern- und Auswärtsgeschäfte-Gesetz, FAGG, BGBl. I Nr. 33/2014) implementing Directive 2011/83/EU; Austrian Consumer Protection Act (Konsumentenschutzgesetz, KSchG).
ECG §5 Disclosure: The mandatory disclosure required by §5 ECG is provided in full in Section 1.0 of this Legal Notice. This satisfies the Austrian statutory obligation for online service providers.
Key National Requirements: Austrian law requires clear disclosure of the right of withdrawal and the model withdrawal form before the contract is concluded. The order button must clearly indicate that it creates a payment obligation ("zahlungspflichtig bestellen" or equivalent). The KSchG provides additional protections including a prohibition on forfeiture clauses that deprive consumers of statutory rights.

Governing National Law: Portuguese Decree-Law 24/2014 of 14 February (distance and off-premises contracts, implementing Directive 2011/83/EU); Decree-Law 84/2021 of 18 October (implementing Directives 2019/770/EU and 2019/771/EU into Portuguese law); Portuguese Consumer Protection Framework Act (Law 24/96 of 31 July, as amended).
Extended Guarantee — Important for Portuguese Consumers: Under Decree-Law 84/2021, the legal conformity guarantee for new goods sold in Portugal is three (3) years from the date of delivery — one year longer than the EU minimum. For used (pre-owned OEM) goods sold in Portugal, the guarantee is reduced to a minimum of one year where disclosed at point of sale, as permitted by Article 10(6) of the Decree-Law.

National Regulatory Authority: Slovak Trade Inspection (Slovenská obchodná inšpekcia, SOI). Website: soi.sk.
Governing National Law: Slovak Consumer Protection Act (Act No. 250/2007 Coll., zákon o ochrane spotrebiteľa); Act No. 102/2014 Coll. on consumer protection in the sale of goods or provision of services under a distance or off-premises contract (zákon o ochrane spotrebiteľa pri predaji tovaru alebo poskytovaní služieb na základe zmluvy uzavretej na diaľku), implementing Directive 2011/83/EU; Slovak Civil Code (zákon č. 40/1964 Zb.).
Key National Requirements: The seller must provide mandatory pre-contractual information in Slovak or a language understandable to the consumer. Act No. 102/2014 requires explicit order confirmation including the obligation to pay (povinnosť zaplatiť) to be clearly indicated on the order button. A withdrawal form must be provided.

Governing National Law: Slovenian Consumer Protection Act (Zakon o varstvu potrošnikov, ZVPot-1, Official Gazette of the RS, No. 130/22) implementing Directives 2011/83/EU and 2019/771/EU; Electronic Commerce Act (Zakon o elektronskem poslovanju na trgu, ZEPT).
Key National Requirements: ZVPot-1 requires all mandatory pre-contractual information to be provided clearly before the consumer is bound by the contract. ECE Type-Approval and National Road Traffic Law
Vehicle lighting sold by Carplaylux may or may not carry E-mark (ECE/UN) type approval. Whether a specific product is lawful for road use in your country depends on: (a) whether the product holds the relevant E-mark approval (ECE Regulation No. 48, No. 112, No. 123, or other applicable regulation); and (b) whether your national road traffic regulations permit its use on vehicles registered in your country. It is the sole responsibility of the buyer to verify road-legal status before installing and using any lighting product on a public road. Carplaylux makes no representation that any product is automatically road-legal in all thirteen countries we ship to.
Professional Installation Recommended
We strongly recommend professional installation by a qualified automotive technician for all lighting assemblies, LED kits, CarPlay and Android Auto infotainment units, and any electronic component that interfaces with factory wiring, CAN-bus systems, or vehicle safety systems (including airbags, ABS, and parking sensors). Improper installation may void the vehicle manufacturer's warranty, cause damage to vehicle electronics, or create safety hazards. Carplaylux accepts no liability for damage arising from incorrect installation.
Used OEM Components — Condition and Guarantee
Genuine used OEM headlight assemblies and other genuine pre-owned components listed on our store are inspected for functional operation before listing. Each used product listing states that the item is pre-owned. The applicable statutory conformity guarantee for used goods is reduced to a minimum of one year from delivery, as permitted under Directive 2019/771/EU Article 10(6), and this is disclosed on each relevant product page. Used goods are not eligible for the same full two-year (or three-year in Portugal and Spain) guarantee that applies to new goods.
Vehicle Identification and Fitment Verification
All products are vehicle-specific. We verify your VIN, make, model, chassis code, and production year before dispatching any order. Fitment claims on product listings are based on confirmed vehicle applications at time of listing; however, factory wiring revisions within a model year may affect compatibility. Fitment issues arising from inaccurate vehicle information provided by the customer do not constitute a conformity defect under Directive 2019/771/EU and are handled under our standard return terms.
Country-Specific Lighting and Road Traffic Regulations
Each of the thirteen countries we serve has its own road traffic regulations governing vehicle lighting. The following is a non-exhaustive summary of key national requirements. These are provided for customer awareness only and do not constitute legal advice. We recommend consulting your national vehicle inspection authority before modifying your vehicle's lighting.
- Belgium: Vehicle lighting modifications must comply with the Belgian Road Traffic Act (Wegverkeersreglement) and are subject to technical inspection (APK/Contrôle Technique). Aftermarket lighting must meet ECE Regulation requirements.
- Czech Republic: Lighting must comply with Decree No. 341/2014 Coll. on technical conditions for vehicles. Periodic vehicle inspection (STK) may flag non-compliant lighting.
- France: French Road Code (Code de la Route) and EU Regulation 2019/2144 govern lighting requirements. DREAL (regional road authority) enforces technical compliance. The use of certain LED retrofit kits without E-mark approval may be illegal on French public roads.
- Germany: German Road Traffic Licensing Regulations (Straßenverkehrs-Zulassungs-Ordnung, StVZO), particularly §§49a–52a, govern lighting standards. Products without the relevant E-mark or ABE (general operating permit, Allgemeine Betriebserlaubnis) may not be road-legal in Germany. Main periodic inspection (HU/AU) by TÜV, DEKRA, or GTÜ will flag non-compliant lighting.
- Hungary: Hungarian Road Traffic Rules (KRESZ) and vehicle type-approval regulations govern lighting requirements. Mandatory periodic inspection (Műszaki Vizsga) enforces compliance.
- Italy: Italian Highway Code (Codice della Strada, D.Lgs. 285/1992) and Ministerial Decrees govern lighting standards. Periodic Revisione inspection may flag non-approved lighting.

Original Manufacturer Parts
Parts sourced from original vehicle manufacturers or their authorised supply chains, including functional pre-owned assemblies removed from donor vehicles. Every genuine OEM product is explicitly described as used/pre-owned where applicable. These parts are inspected for function before listing. OEM part numbers are stated on product pages where known. We do not describe used parts as new.
Factory-Specification Third-Party Parts
New components manufactured by third parties to match the original vehicle manufacturer's form, fit, and functional specifications. These are not manufactured by or affiliated with the vehicle brand and are sold at a different price point accordingly. OEM-Style products are never described as "genuine OEM" in our listings. They are described as OEM-Style, OEM-specification, or factory-replacement to accurately characterise their origin.
Performance and Styling Upgrades
Products not intended to replicate a factory part but rather to upgrade or enhance the vehicle's lighting or infotainment beyond factory specification. These are described as aftermarket modifications — not OEM replacements — in every listing. Dynamic Dragon Scale rear lights, enhanced sequential LED assemblies, and app-controlled RGB headlight systems typically fall in this category. Road-legal status must be independently verified by the buyer for aftermarket products.
Because many of our products are matched to a specific chassis code, model year, and factory wiring configuration, we do not claim universal fitment. Limitation of Liability
Scope of Liability. Batterijen.net / Carplaylux accepts unlimited liability for: (i) damage caused by wilful misconduct or gross negligence on our part; (ii) injury to life, body, or health caused by our negligence; (iii) product defects under the Product Liability Directive (Section 10); and (iv) fraud or fraudulent misrepresentation. These heads of liability cannot be excluded or limited under Dutch or EU law and are not limited by this clause.
Limitation for Ordinary Negligence. To the maximum extent permitted by applicable Dutch law and mandatory consumer protection regulations, Batterijen.net's liability for damage caused by ordinary (not gross) negligence is limited to the purchase price paid for the specific product giving rise to the claim.
Consequential and Indirect Damages. Subject to mandatory consumer law, we are not liable for indirect or consequential damages, including loss of profit, loss of use, loss of data, or business interruption, arising from or connected with the purchase or use of products from carplaylux.com.
Road-Use and Installation Liability. Force Majeure. Batterijen.net is not liable for delays or failures in performance caused by events outside our reasonable control, including but not limited to natural disasters, strikes, pandemics, carrier disruptions, government actions, or infrastructure failures.
Consumer Rights Always Apply
Nothing in this limitation of liability clause affects your statutory rights as a consumer under EU or national law. In particular, the 14-day right of withdrawal (Section 4), the statutory conformity guarantee (Section 4), and mandatory product liability rights (Section 10) are unaffected by this clause. If any limitation in this section is found to be unenforceable under the mandatory law of your country of residence, the limitation will be modified to the minimum extent necessary to make it enforceable.
Statutory Product Liability
Product liability for goods sold by Carplaylux is governed by the EU Product Liability Directive 2024/2853/EU (which modernises and replaces Council Directive 85/374/EEC, as implemented in the Netherlands under the Dutch Civil Code Articles 6:185–6:193) and by applicable national implementing legislation in each country where we operate. This statutory regime cannot be contractually excluded.
What Product Liability Covers
Under the Product Liability Directive, a manufacturer, importer, or distributor may be liable for damage caused by a defective product — that is, a product that does not provide the safety a person is entitled to expect, taking into account all circumstances including the product's presentation, reasonable expected use, and the time at which it was placed on the market. The new Directive 2024/2853/EU extends liability to damage caused by defective products within a 10-year limitation period and covers personal injury, damage to property, and, for the first time, psychological harm and damage to data under certain conditions.
Our Role in the Supply Chain
Batterijen.net / Carplaylux operates as a retailer and importer of automotive electronics, lighting, and accessories. Where we import products into the EU from manufacturers established outside the EU, we may be treated as the "importer" under the Product Liability Directive and may bear liability accordingly. We select suppliers carefully and maintain records of our supply chain. Where a product defect claim arises, we will cooperate in identifying the manufacturer and, where necessary, will assist consumers in bringing claims against the appropriate liable party.
Road Use and Liability
Product liability does not extend to damage caused by: (a) using a product in a way that is inconsistent with its intended use or the instructions provided; (b) modifications made to a product after it was placed on the market; or (c) using a lighting product in a manner that is not authorised under applicable national road traffic law. Buyers remain responsible for verifying road-legal status and ensuring proper installation of all products purchased from Carplaylux.
Website Content, Pricing, and Product Availability
Pricing. All prices displayed on carplaylux.com are stated in Euros (EUR) and are inclusive of the applicable Dutch VAT rate unless a product listing specifies otherwise. Prices are subject to change without notice, but the price confirmed at checkout is the price applicable to your order. We do not apply dynamic or personalised pricing that varies by individual customer.
Free Shipping Threshold. Free standard shipping applies to all orders above €150. Orders below this threshold may incur a shipping charge, which will be clearly displayed during checkout before payment is taken.
